These Terms of Service (the “Terms”) govern your access to and use of the Filme: AI Movie Generator mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. The Service

Filme lets you create, manage, and export AI-assisted videos and related content from the prompts and inputs you provide. Features depend on your plan and may require an internet connection. We may add, change, or remove features at any time.

3. Accounts and device identity

Core features do not require an account. The app uses a device-scoped identifier to enforce free-tier limits, subscription state, and abuse prevention. You are responsible for the activity that occurs on your device.

4. Subscriptions, credits, and purchases

• In-app purchases are processed by Apple through the App Store. Apple’s terms and payment processing apply.
• The Service may offer auto-renewing subscriptions and consumable credit packs. Subscription pricing, billing period, and renewal terms are shown in the app before purchase.
• Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel subscriptions in your Apple account settings.
• Credits are consumable and are spent when you use certain features. Credits have no cash value, are non-transferable, and are non-refundable except where required by law.
• Refunds for App Store purchases are handled by Apple under Apple’s policies.

5. Acceptable use

You agree not to:

• Use the Service to create, upload, or share content that is unlawful, infringing, defamatory, harassing, hateful, sexually exploitative, or that violates the rights of others.
• Upload media you do not own or do not have permission to use, or use the likeness or identity of any person without their consent where required.
• Attempt to reverse engineer, bypass usage limits, abuse credits, or interfere with the Service or its security.
• Use the Service to violate any law or any third-party provider’s terms.

We may suspend or terminate access for violations.

6. Your content and rights

You retain ownership of the inputs you provide. To operate the Service, you grant us a limited license to process your inputs and the resulting outputs for the purpose of providing and improving the Service. You are responsible for ensuring you have the rights necessary to submit your inputs.

7. AI-generated content

Outputs from AI features are generated automatically and may be inaccurate, unexpected, or similar to other outputs. They are provided for creative and entertainment purposes and are not professional advice. You are responsible for reviewing outputs before you use or share them, and for complying with applicable law.

8. Third-party services

The Service relies on third-party AI, analytics, cloud, and messaging providers. Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.

9. Intellectual property

The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid for the Service in the 12 months before the claim.

12. Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate your access if you violate these Terms or to protect the Service and its users. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. We will post the new version and update the “Last updated” date. Material changes will be communicated as required by law. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws applicable in your jurisdiction to the extent required, and otherwise by generally applicable principles, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable rights you have under local law.
